1. Introduction and Platform Architecture

Welcome to WaQtor. These Terms of Service ("Terms") govern your access to and use of our WhatsApp automation platform. WaQtor operates as a Multi-Tenant Software as a Service (SaaS). This means your data is logically separated from other users to ensure privacy and security.

By accessing or using our Services, you agree to be bound by these Terms. Our platform utilizes advanced queue architecture (Redis) to process large message campaigns asynchronously, ensuring high performance.

2. WhatsApp Integration & Assumption of Risk

Important Disclaimer & Limitation of Liability

WaQtor is an independent platform and is NOT affiliated with, authorized, maintained, sponsored, or endorsed by Meta Platforms, Inc. or official WhatsApp. Our system utilizes a self-hosted integration (via Evolution API protocol) connecting through web socket/multi-device simulation.

  • Account Ban Risk: Because WaQtor relies on an unofficial integration, you acknowledge that aggressive messaging, spamming, or violating WhatsApp's Commerce Policies carries a high risk of your WhatsApp number being permanently banned by Meta.
  • No Liability: WaQtor provides the service "As Is". We hold absolutely zero liability for any blocked numbers, lost contacts, or business damages resulting from Meta's enforcement actions. The user bears 100% responsibility for how they utilize the platform.
  • Service Stability: Continuous operation depends on the stability of third-party open-source libraries. We do not guarantee uninterrupted WhatsApp connectivity.

3. Artificial Intelligence (AI) Features

WaQtor includes AI-assisted writing tools powered by OpenRouter, utilizing models such as Google Gemini and Alibaba Qwen.

  • Data Processing Scope: Only the "Campaign Description" you explicitly provide is sent to our AI providers to generate message templates.
  • Customer Privacy: Incoming chat messages from your customers are NOT sent to third-party AI models. The AI functionality is strictly limited to assisting SaaS owners in drafting outgoing campaigns.
  • Model Training: WaQtor does not use your campaign prompts to train AI models. However, requests processed via OpenRouter are subject to their respective privacy and temporary retention policies.

4. Data Storage and Privacy Overview

We collect necessary account data (Name, Email, Timezone) and encrypt your passwords. Customer data you process (Phone numbers, Chat History, Media) is stored securely in our PostgreSQL databases and local file systems.

Chat history is stored to provide you with an interface to interact with your clients. You are completely responsible for obtaining the necessary consent from your contacts to process their data in according with your local jurisdiction. For more details, please review our Privacy Policy.

5. Subscriptions and Billing

Currently, account upgrades, plan provisioning, and billing are handled manually by the WaQtor administrative team. By requesting an upgrade, you agree to the custom pricing terms discussed directly with our management. Automated payment gateways will be governed by updated terms once implemented.
